Hiking Electricity Rates for Wyomingites by Allowing Utility Companies to Add Fees and Alter Rates on Net Metered Customers

This initial bill expands the size of solar installations that qualify for the state's "net metering" law which requires public utility companies to purchase any excess energy which is produced by homeowners or businesses through the solar panels they may own. The bill increases the maximum generation capacity for qualifying net metering systems from 25 kilowatts to 200 kilowatts, allowing for larger installations (benefiting ranches, farms, churches, schools, businesses, and municipal facilities beyond just residential use). However, the Senate added provisions that would allow utility companies to impose additional fees or alter compensation rates on net metering customers (both existing and new). The Senate also added an amendment that stripped certain protections, potentially exposing rooftop solar owners to undefined new charges. Net metering expansions indirectly subsidize "green" energy at the expense of traditional utilities or ratepayers, shifting costs to non-solar customers or undermining coal and oil.

Under existing law, a sales-tax exemption is provided for sales of power or fuel to a person transporting tangible personal property by railroad or pipeline, as long as the power of fuel is consumed directly for the transportation of the property. This bill clarifies that the exemption applies regardless of who owns the transported tangible personal property. The bill also provides a definition for "pipeline" as a system of connected pipes and other equipment used to transport oil, natural gas, or other hydrocarbons from a well site to an interstate or intrastate transmission customer sales delivery point. All state and local tax codes should be constructed in a broadly applied manner with as low of rates as possible for everyone. Tax cronyism enacted under this measure further shifts tax burdens to all other industries and companies that do not transport property under this law.

Specifically, the bill requires energy companies to either acquire 66% of the entire land area or 66% of the landowners, before they would have the ability to use eminent domain. Additionally, the bill implements minimum compensation to be paid to property owners and stipulates that any improvements to the property shall be included in its fair market value. Using an existing easement to place additional energy collector systems is prohibited, unless certain requirements are met, and any order allowing placement of energy collector systems must include liability and reclamation clauses. This measure is a step in the right director to maintain strong property right protections, which is an essential component of ensuring a free and prosperous society.

This bill expands the water, irrigation, and sewer district public works projects that are exempt from competitive, sealed bidding requirements by increasing the project cost thresholds up to $75,000. Specifically, the bill requires competitive bids for projects handled by irrigation districts with a cost over $75,000 (previously $7,500) and projects handled by water and sewer districts with a cost over $75,000 (previously $30,000). Contracts related to irrigation works, power plants or systems, and the purchase of materials and machinery must meet bid requirements if the estimated cost of the project exceeds $20,000 (previously $1,000).

This bill strengthens property rights by creating a process for property owners to request assistance from a law enforcement agency to immediately remove "unauthorized persons." Under the bill, the property owner must submit a complaint to a law enforcement agency containing numerous assertions, including that the unauthorized person is dwelling on the property unlawfully, isn't present due to a lease or agreement, or isn't closely related to the property owner. The bill does provide cause for civil action for any person harmed by a wrongful removal under this measure. The bill also establishes criminal offenses for unlawfully advertising or providing false documents for fraudulently leasing or advertising real property.

This bill requires the state treasurer to acquire no less than $10 million in "specie and specie legal tender" as part of the permanent Wyoming Mineral Trust Fund. Under the bill, "specie and specie legal tender" includes coin having gold or silver content, as well as refined gold or silver bullion which is coined, stamped, or imprinted with its value based primarily on its metal content. The state treasurer may invest in precious metal leases or bonds payable in precious metals, if market conditions warrant it. Lastly, the department of revenue is required to study methods for the state to begin accepting gold and silver as a payment method. This measure helps ensure taxpayers are diversified and protected in the event of extreme inflation or a hyper-inflation scenario. This is especially critical considering the reckless policies of the Federal Reserve such as quantitative easing.
